Terms & Conditions for Advertisers
By advertising on this website, cottage owners
agree to the following terms and conditions.
Accuracy
West Wales Cottages cannot accept any legal
responsibility for the accuracy of the advertisements, or any alleged
breaches of contract on an advertiser's part and the advertiser
indemnifies West Wales Cottages against all costs, expenses and losses
arising out of a claim relating to the content of an advertisement.
Advertisers are responsible for keeping their availability accurate and
up-to-date by informing West Wales Cottages of any bookings.
Advertisers should inform us immediately of any material change
required in the description of the property.
Liability
West Wales Cottages does not warrant that the operation
of the West Wales Cottages site will be uninterrupted or error-free. In
no event shall West Wales Cottages be liable to the advertiser for any
special, consequential, incidental or indirect damages, including lost
profits.
Cottage owners are entirely responsible for ensuring that their
property and grounds are properly maintained, cleaned and prepared for
guests for each booking. Complaints regarding cleaning and the
preparation of properties received by West Wales Cottages will be
referred to the owners.
All cottage advertisers must have specific holiday home liability
insurance and West Wales Cottages cannot be held liable for claims
arising from loss or damage to the contents of the property, loss of
revenue, public liability or compensation.
Damage / Loss / extra cleaning etc
West Wales Cottages standard Terms and Conditions of rental state
that the contract of hire is between the hirer and the property owner.
Any claim for 'loss of enjoyment', by guests for any reason, or any
claim for damage, loss or extra cleaning caused by guests from the
owners, is entirely the responsibility of the property owner.
West Wales Cottages, as either advertisers or booking agents cannot act
on an owner's or guest's behalf in cases of dispute arising from any
cause.
Serious complaints - West Wales Cottages cannot guarantee
inspection of a property in the event of a serious complaint made by
guests at any time during their stay and where the owner cannot be
contacted immediately, West Wales Cottages reserves the right to
relocate the guests in alternative accommodation. Subsequent payment for
the holiday will then be made to the owner of the property in which the
guests have been relocated and not to the owner of the property in which
guests had initially booked, either in full or pro rata, whichever
applies. Holiday let owners can insure themselves against loss of rental
income should the unexpected occur. It is important to verify with your
insurer under what circumstances you can claim.
Photographs
West Wales Cottages will make every effort to safeguard
all materials supplied, and return them if required, but cannot be held
responsible for any loss or damage, however caused, and for any loss or
damage sustained. Every effort will be made to reproduce accurately all
advertisements submitted, but West Wales Cottages cannot be held
responsible for any loss or damage or otherwise resulting from errors
or omission.
Option 1 advertising - For option 1 and 2 advertisers, we will
probably visit
your property to confirm description and content. We will take all the
photographs used on the website and reserve copyright to these and
reserve the right, to amend, edit or refuse copy provided by advertisers
or agents.
Copyright authorities
The advertiser
represents and warrants that he (a) owns the copyright in the
photographic and textual material supplied by him to West Wales
Cottages (the Material) or (b) has been authorised by the owner of the
copyright in the Material to grant West Wales Cottages permission to
use the Material as below.
The advertiser grants
West Wales Cottages permission to use the Material for promoting the
advertisers property for the duration of the advert.
The advertiser
irrevocably and unconditionally indemnifies West Wales Cottages
immediately on demand against any cost, loss or liability (including
legal costs) which West Wales Cottages may incur by reason of any
breach of copyright arising from its use of the Material.
The advertiser
understands that it may not reproduce photographic or textual material
from any part of the West Wales Cottages website without permission
from the relevant copyright owner.
The text, files, images, photos, maps and other materials on this
website (collectively, the "content") are only for your personal use.
All content on the Site, and the Site itself, is protected by copyright
and database rights, and you will abide by any and all additional
copyright notices, information, or restrictions contained in or relating
to any content on the Site. Copying or storing of any content for other
than for your personal, non-commercial use is expressly prohibited
without the prior written permission from us or the applicable copyright
holder. As part of the rental enquiry process, for your own personal,
non-commercial use and not for further distribution to any third party.
You may download, display, and/or print one (1) copy of any portion of
the Site. You may not modify the same, and you must reproduce our
copyright notice in the form "© R. Attrill" as displayed on
the relevant portion(s) of the Site that you desire to download, display
or print.
Unauthorized Use.
4.1. Unless otherwise provided within these Terms, or unless otherwise
applicable British law requires us to allow you to do so, you may not do
any of the following without our prior written consent:
- Copy, reproduce, upload, post, display, republish,
distribute, or transmit any part of the content in any form
whatsoever.
- Reproduce any portion of this Site on your website
or otherwise, using any device including, but not limited to, use of a
frame or border environment around the Site, or other framing
technique to enclose any portion or aspect of the Site, or mirror or
replicate any portion of the Site.
- Modify, translate into any language or computer
language, or create derivative works from, any content or any part of
this Site.
- Reverse engineer any part of this Site, save to the
extent expressly permitted by applicable law.
- Sell, offer for sale, transfer, or license any
portion of the Site in any form to any third parties;
Use any robot, spider, other automatic device, or manual process to
monitor, copy, or keep a database copy of the content or any portion
of the Site.
- Use the Site other than to advertise and/or
research holiday rentals and to make legitimate enquiries to our
advertisers.
- Use the Site to make any false, fraudulent or
speculative reservation, or any reservation in anticipation of demand.
- Post or transmit any unlawful, threatening,
abusive, libelous, defamatory, obscene, vulgar, indecent,
inflammatory, sexually explicit, pornographic or profane material or
any material that could constitute or encourage conduct that would be
considered a criminal offense, give rise to civil liability, or
otherwise violate any law or for any other purpose that is unlawful or
prohibited by these Terms.
- Post or transmit any information that constitutes
or contains false or misleading indications of origin or statements of
fact.
- Use or access the Site in any way that adversely
affects the performance or function of the Site, or any other computer
systems or networks used by us or the Site, or infringes on our
copyright or any copyright of our advertisers.
- Violate, plagiarize or infringe the rights of third
parties including, without limitation, copyright, trademark, patent,
rights of publicity or privacy or any other proprietary rights.
- Upload or transmit to the Site or use any device,
software or routine that contains viruses, Trojan horses, worms, time
bombs, or other computer programming routines that may damage,
interfere or attempt to interfere with, or intercept, the normal
operation of the Site, or appropriate the Site or any system, or take
any action that imposes an unreasonable load on our computer
equipment, or that infringes upon the rights of any third party; or
disguise the origin of the information transmitted through the Site.
- If you are aware of or experience any content,
activity or communication through or in connection with the Site that
appears to be in violation of the above, or in violation of any other
provision of these Terms, we ask that you please inform us of any such
violation by sending an email to westwalescottages@virginmedia.com .
Layout and design of West Wales Cottages property advertising
West Wales Cottages reserves the right to determine the final design layout of the individual customer's pages, including the
right to remove, change, edit, copy or amend layouts or photographs supplied.
West Wales Cottages also reserves the right, to amend and edit copy
provided by advertisers. West Wales Cottages cannot be held responsible
for any loss, or damage, resulting from the design, or positioning, of
the properties on the website, or changes made to the photographs and
copy submitted by the customer.
External links
West Wales Cottages reserves the right to refuse hypertext links to
commercial accommodation advertisers, or addresses of, other web sites
from advertisers' pages. Links will be provided to owner's personal
websites for options 3 or 4 from the property's main page only. External links will not be displayed on
general listing pages.
For option 1 advertisers, owner's website links will not be shown as
West Wales Cottages will be taking the bookings resulting from visits to
the West Wales Cottages website.
Grading
We do not require a star rating to list a property, although we
would expect the minimum standard of advertised properties to be
equivalent to at least a 4 star rating. Visit Wales' grading logos and logos from other Tourism / Travel
grading schemes will not be displayed on index or listing pages as many
properties do not subscribe to the Visit Wales or other similar schemes.
To ensure fairness, the display of such logos on some properties only,
might imply that these are of a higher standard than those that do not
display ratings logos.
Advertising more than one property on one advertisement
Each advertisement on the West Wales Cottages site
displays an individual property where people will spend their holidays
- not examples of properties in a given area. Only one property can
appear on each advertisement, unless it is a property with multiple
rental units on the same site, and additional advertising units are
purchased. West Wales Cottages reserves the right to amend the copy or
remove the advertisement, when more than one property is described in
the advertisement.
Exclusive advertising
Options 2 and 3 advertisers (see advertising page) can be listed
with as many agencies as they wish, but advertisers choosing option
1 must advise West Wales Cottages as soon as a booking is obtained
elsewhere - This is to ensure that there is no possibility of double
bookings. If West Wales Cottages processes a holiday booking that
has been previously booked by another agent without West Wales
Cottages being so informed, then the owner will be liable for the
10% commission due at the time the booking was made.
Termination of advertising
If advertisers wish to have their advertisement removed from the Internet before the end of their
subscription period, this will be done, but no refunds will be
made.
If an advertised property is sold, the advertising can be transferred to
the new owners, but will be considered as a new advert for billing
purposes.
West Wales Cottages reserves the right to refuse any advertisement for
the West Wales Cottages web site, and will not be liable for any loss
or expense in so doing.
If West Wales Cottages receives a complaint from a person who has
rented an advertiser's property which West Wales Cottages, acting
reasonably, consider is justified, or an advertiser knowingly
double-books a property, or engages in any unacceptable practices or is
in breach of its obligations to West Wales Cottages , then West Wales
Cottages reserves the right to remove the property from the West Wales
Cottages web site without notice.
Cancellation of bookings by owners
In the event that an owner asks West Wales Cottages to cancel a booking
for which full or part payment has already been made, then the
owner will be liable for the commission due at the time the booking was
made.
Privacy
West Wales Cottages treats the personal information of
site users with the utmost respect and confidentiality and takes
reasonable steps to ensure that your personal information is stored
securely and accurately. Your personal information will never be
provided to any third party for their marketing or promotional use.
Contacting Property Owners
In the interest of maintaining a high level of service to
holidaymakers using the site, we require all advertisers to be
available to respond to enquiries by telephone or email. We will change
your regular telephone number and email address if it changes,
but cannot make temporary changes for holidays etc. Should advertisers
be unavailable for a period of more than 1 week, we ask them to leave
an answerphone message to that effect or set up an out of office
response on their email account.
Changes to pricing and conditions
West Wales Cottages reserves the right to change the
rates and terms and conditions without notice. Any new rates will be
applicable immediately for new advertisers and upon renewal for
existing advertisers.
